Senator Mark Kelly, representing Arizona, engaged in a robust discussion on MS NOW’s “The Rachel Maddow Show” this Monday. He addressed the Pentagon’s recent announcement regarding a formal review of allegations related to a video in which he encouraged service members to refuse illegal orders.

The Pentagon’s announcement includes a possibility of calling Kelly back to active duty to face court-martial proceedings or other disciplinary actions under the Uniform Code of Military Justice, commonly known as UCMJ.

While speaking with Maddow, Kelly expressed his sentiments about the Pentagon’s investigation, stating, “What I said was straightforward and non-controversial: military personnel should adhere to the law. In response, Donald Trump called for my execution, my hanging, and even suggested that I should be prosecuted.”

Kelly further noted President Trump’s alarming comments, where he suggested, “go get them,” implying that there might be plans to incite a mob against him and his colleagues.

“This is revealing more about him than it does about me. He is clearly avoiding accountability. Yet, I want to make it known that I will not be silenced or intimidated,” Kelly asserted with conviction.

Concerns About Potential Illegal Orders

Following Kelly’s remarks, Maddow pressed him on which specific illegal orders he and his colleagues worried about when they produced the video urging service members to refuse unlawful commands.

Kelly responded with a striking analogy, stating, “You don’t wait for a child to get hit by a car before telling them to look both ways. It’s common sense.” He also referenced a 2016 debate in which Trump indicated that the military would follow his orders, even illegal ones, demonstrating a concerning disregard for the law.

Trump’s Controversial Remarks on Military Action

Continuing his critique of Trump, Kelly detailed troubling instances where Trump discussed the potential of military action against American citizens. “There were comments about shooting protesters in the legs, and thankfully, Mark Esper and Mark Milley intervened to clarify that such suggestions were unacceptable,” Kelly explained.

Moreover, Kelly raised alarms about Trump’s recent talk of invoking the Insurrection Act to send military troops into U.S. cities, using civilians as training tools for the military. “We aimed to remind individuals in the military of their legal obligations and reassure them that we support them in responsible decision-making,” he added.

He emphasized that his intent was to promote accountability in government actions, pointing out that the backlash was unexpected. Referring to Trump’s provocative statement that they should face execution, Kelly highlighted the stark reality of their political climate.

The Pentagon’s Response and Implications

The White House has yet to respond to inquiries from Fox News Digital regarding the Pentagon’s investigation into Kelly’s actions. Last week, Kelly collaborated with five other Democratic lawmakers to release a video directed at military personnel and intelligence officers reminding them that they have the right to refuse illegal orders.

Among the other Democrats involved, four have prior military experience but are not currently retired, placing them beyond the scope of the UCMJ. One advocate, Senator Elissa Slotkin from Michigan, is a former CIA officer.

War Secretary Pete Hegseth commented on the situation, stating, “The Department is currently reviewing Senator Kelly’s statements and actions, which addressed all troops and utilized his military rank, creating a perception of authority.” Hegseth further observed that Kelly’s conduct could discredit the armed forces and might warrant suitable disciplinary measures.

Trump’s Accusations and Our Political Environment

In a swift response to the video, Trump accused the lawmakers of engaging in “seditious behavior” and insisted they should face severe consequences, including arrest and trial. He dramatically stated that this behavior was “punishable by DEATH!” This assertion underscores the heightened tensions in political rhetoric surrounding military conduct and accountability.
