Jerome Powell Warns Major Supreme Court Case Risks Federal Reserve’s Independence

On Wednesday, Federal Reserve Chair Jerome Powell issued a stark warning regarding a Supreme Court legal battle involving Fed governor Lisa Cook. He indicated that this case could significantly impact the central bank’s independence and the broader U.S. economy.

Powell described the case as potentially the most critical legal proceeding in the 113-year history of the Federal Reserve. He mentioned to reporters that it would have been hard for him to explain his absence from such a pivotal event. Powell referenced former Federal Reserve Chair Paul Volcker, who attended a similar Supreme Court case in the mid-1980s, establishing a precedent.

The Heart of the Legal Battle

Last week, the Supreme Court engaged in two hours of oral arguments concerning whether then-President Donald Trump retains the authority to remove Cook from the Federal Reserve’s Board of Governors. A ruling from the court is anticipated by summer.

This legal struggle began in late August when Trump announced he was firing Cook from her position on the Federal Reserve Board. He accused her of misrepresenting details about three mortgages she secured before her appointment to the central bank. Cook has firmly denied any wrongdoing and has not faced any charges.

Legal Actions Taken

In response to Trump’s claims, Cook filed a lawsuit in federal court in Washington, D.C., seeking to prevent her removal. On September 9, a district court judge ruled that Trump could not fire her while litigation was ongoing, a decision upheld by a federal appeals court.

Cook’s appointment marked a historic milestone. Appointed by President Joe Biden in 2022, she became the first Black woman to serve on the Federal Reserve Board, the essential seven-member panel tasked with setting national interest rates and supervising the banking system.

The Unprecedented Context

Cook now finds herself at the focal point of an extraordinary situation, as Trump’s attempt to dismiss her would represent an unprecedented action in the Federal Reserve’s history. Additionally, Powell’s previous assurance to finish his term, which concludes in May, is now overshadowed by a Justice Department criminal investigation concerning his congressional testimony related to the renovation of the Federal Reserve headquarters.

Powell confirmed this investigation, acknowledging it while asserting his respect for the rule of law and congressional oversight. However, he characterized the inquiry as
