FIRST ON FOX – South Carolina Attorney General Alan Wilson announced his intention to prosecute a Salvadoran illegal immigrant charged in the fatal hit-and-run of a University of South Carolina student. This tragic incident occurred on a Wednesday, sparking serious legal actions.
Rosali I. Fernandez-Cruz, aged 24, faces multiple charges including hit-and-run resulting in death, failure to provide information and assistance, failure to yield the right of way, and driving without a license, all linked to the death of 21-year-old Nate Baker. This information comes from a statement released by the Columbia Police Department.
In a stern message to those residing in the country illegally, especially gang members associated with groups like TDA or MS-13, Wilson emphasized that his office is prepared to take action. He stated, “We’re coming for you, and we’re going to leave no place for you to hide. If you pose a threat to the people of South Carolina, this office will be coming for you,” during his remarks to Fox News Digital.
Additionally, Wilson urged those in the country illegally but not involved in violent activities to pursue legal pathways to citizenship. He encouraged individuals to report themselves and adhere to lawful processes, emphasizing the importance of following the same steps taken by countless immigrants seeking a better future for themselves and their families.
Baker was riding his motorcycle when he collided with Fernandez-Cruz, who allegedly failed to yield while making a left turn at the intersection of Blossom and Assembly Streets in Columbia. This fatal accident left the USC junior dead, prompting widespread grief among his peers.
At the time of the accident, Baker was a business major and an active leader in the Phi Gamma Delta fraternity. His leadership and dedication to his fraternity significantly impacted the university community.
Wilson acknowledged the pressing issue of illegal immigration and its link to violent crime in America. He expressed his gratitude for the efforts made during the Trump administration to tighten border security, likening it to repairing a boat with numerous leaks. Despite these improvements, he cautioned that dangerous individuals and drugs continue to infiltrate the country due to illegal crossings at the southern border.
Moreover, Wilson reaffirmed the commitment of South Carolina officials to collaborate with state and federal partners in addressing the challenges posed by violent offenders. He stated, “We are committed here in South Carolina to working with our state partners and our federal partners to remove those individuals who threaten the health and safety of our communities.”
According to a source from the Department of Homeland Security, Fernandez-Cruz was previously apprehended by border patrol agents in Hidalgo, Texas, on December 24, 2016. In September 2018, an immigration judge in Charlotte, North Carolina, ordered her deportation back to El Salvador.
At the time of the hit-and-run incident, police verified that Fernandez-Cruz was already wanted by Immigration and Customs Enforcement.
During the accident, two additional men were with Fernandez-Cruz but fled the scene. The current legal status of these individuals remains unknown, and no charges have been filed against them.
The Phi Gamma Delta chapter at USC expressed deep sorrow over Baker’s death. They described him not only as a brother but also as a leader, a role model, and a representation of the fraternity’s values.
In an emotional tribute shared via Instagram, the fraternity stated, “Nate Baker brought light, laughter, and love into all of our lives. He will always be remembered for the way he showed up for others and the impact he had on everyone around him. His passion, loyalty, and love for this brotherhood will never be forgotten. May we honor his memory by living with the same kindness, selflessness, and generosity that he showed to everyone around him. Rest in Peace Nathaniel Baker.”
