The Cost of Dissent: A University’s Decision Sparks Legal Battle Over Free Speech

Life can change drastically in a matter of moments. For many professionals, years of dedication and hard work culminate in a career marked by accomplishments and respect. I dedicated my life to the field of psychiatry, building my expertise over decades. My career reached a peak when the University of Louisville appointed me to lead its Division of Child and Adolescent Psychiatry and Psychology.

However, everything took an unexpected turn in 2017 after nearly 15 years of service recognized for its contributions. The university that once celebrated my expertise demoted me for voicing my opinions. The situation escalated, leading to my termination in 2019. This article narrates the circumstances surrounding this abrupt change.

The Triggering Discussion

My professional journey led me to join a think-tank panel focused on gender dysphoria and its treatment. During a discussion, I emphasized the importance of addressing the psychological underlying factors influencing a child’s confusion before rushing into medical interventions. My recommendation was simple and rooted in common sense: understanding the emotional struggles of children should take precedence over initiating medical procedures such as puberty blockers, cross-sex hormones, or surgical interventions.

Drawing on my 35 years of experience in child and adolescent psychiatry, I expressed doubt about the emotional maturity of children and adolescents in making complex decisions regarding gender identity. The evidence indicated that the majority of children grappling with gender dysphoria—between 80 and 95 percent—eventually accept their biological sex without undergoing social transition or medical treatments.

My views, while based on research and experience, collided with a prevailing cultural wave that strongly supported immediate gender transition narratives. I soon realized my stance was out of alignment with the expectations of certain educators and medical professionals who held different views.

The Consequences of Defiance

Unfortunately, facts and reason did not shield me from repercussions. The university, having embraced a specific ideological approach to gender identity, swiftly moved to silence dissenting opinions. It became clear that the institution prioritizing ideological conformity over academic discourse would not tolerate the insights I brought to the discussion.

Consequently, I experienced a series of demotions that slowly erased my professional presence within the university. The gradual isolation culminated in my dismissal after more than a year of mounting tension. My career was effectively dismantled due to my willingness to express my personal and professional beliefs.

A Fight for Free Speech

In light of these actions, I turned to legal recourse, supported by Alliance Defending Freedom. I filed a lawsuit against the University of Louisville, asserting that their actions infringed upon my First Amendment rights to free speech. After years of legal struggles, during which I prepared for a trial set for this summer, university officials agreed to settle the case. The settlement totaled nearly $1.6 million—an acknowledgment of the damage inflicted upon me and the unwarranted harm to my reputation.

This financial recompense signifies more than just monetary relief. It serves to underscore the need for academic institutions to uphold the principle of free speech and the exchange of ideas, discouraging similar violations against professors in the future.

Shifting Perspectives on Gender Issues

In an encouraging turn of events, public sentiment is shifting concerning gender dysphoria. Many have started to resonate with my concerns regarding the treatment of children facing these challenges. Legal decisions, like that from the U.S. Court of Appeals for the 11th Circuit, reinforced that schools can maintain separate facilities for boys and girls, preserving traditional norms amid changing ideologically driven perspectives.

Moreover, several states, including Tennessee and Kentucky, have enacted laws aimed at protecting children from unnecessary medical procedures. These laws, upheld by the 6th Circuit, reflect a growing awareness and caution around the application of gender identity politics in medical contexts. Additionally, international medical bodies, including those in the UK, are acknowledging potential risks in the current approaches to gender dysphoria.

A Call for Ethical Treatment

Despite this progress, a pressing issue remains. The damaging consequences of ideology-driven medical policies continue to affect children daily. Vulnerable youth experience profound physical, emotional, and spiritual harm due to a medical framework that often prioritizes ideology over evidence-based practices.

As healthcare professionals, it is our ethical obligation to provide care that is free from the constraints of political correctness. Doctors must offer patients comprehensive medical alternatives when it comes to understanding and addressing emotional distress related to gender identity. Anything less constitutes a betrayal of the trust bestowed upon healthcare providers and risks the well-being of young individuals seeking help.

Therefore, fostering an environment of open dialogue and respect for diverse opinions is crucial not only for academic freedom but also for the well-being of those in our care. In this increasingly polarized climate, the commitment to uphold ethical standards must prevail for the safety and health of future generations.
