Lawyers representing Sean Diddy Combs have submitted a letter advocating for a renewed motion for a mistrial, citing prosecutorial misconduct in a federal court case. The documents obtained reveal serious allegations regarding the integrity of the testimony presented during the proceedings.
On June 7, Diddy’s legal team filed this motion in the Southern District of New York. They assert that the prosecution knowingly included false testimony, which could significantly impact the trial’s outcome.
During the trial, jurors heard testimony from Bryana “Bana” Bongolan, a friend of Cassie Ventura. She alleged that Diddy dangled her over a 17th floor balcony in September 2016. However, parts of her testimony raised questions after Bana struggled to recall crucial details, including her state of mind due to drugs at the time of the incident.
Claims of Perjury and Its Impact
Diddy’s attorneys pointed out that when perjured testimony leads to a criminal conviction, if the prosecution knew or should have known about the perjury, the conviction must be overturned. The team emphasized the importance of safeguarding the integrity of the judicial process.
The lawyers stated that perjured testimony can violate the Due Process Clause, undermining a witness’s credibility. They firmly argued that the prosecution’s actions compromised Diddy’s right to a fair trial.

Bongolan took the stand in support of the government for two days. She confirmed her role in the Bad Boy Reunion tour during September 2016 but admitted to not remembering Diddy or Cassie’s itinerary during that time.
Diddy’s lawyer, Nicole Westmoreland, presented documents to help refresh Bongolan’s memory. Notably, she asked if Diddy had been performing in New Jersey on September 25, 2016, but Bongolan could not recall. Likewise, she was unaware of any details regarding Diddy and Cassie’s presence in New York on September 26.
Westmoreland pressed critical questions regarding the timeline of events and the alleged injuries related to the balcony incident, emphasizing that Mr. Combs could not have caused the injuries claimed by Bongolan.
