A grieving family has been awarded $2.25 million following a Fulton County court ruling that a pathologist violated their privacy by posting autopsy images of their decapitated baby on social media.
Dr. Jackson Gates, operating Gates Rapid Diagnostic Laboratory in metro Atlanta, faced significant legal ramifications after a jury found him liable for both compensatory and punitive damages. The jury awarded the couple $2 million in compensatory damages and an additional $250,000 as the maximum punitive damages, according to information reported by affiliate FOX 5 Atlanta.
The child’s mother, Jessica Ross, encountered a critical complication known as shoulder dystocia during her delivery on July 9, which prompted a rushed Cesarean section. Tragically, this medical emergency resulted in the death of the newborn.
Jessica Ross and her partner, Treveon Taylor Sr., subsequently filed a lawsuit against Southern Regional Medical Center and the obstetrician involved. They alleged that the doctor forcefully pulled on the baby’s head and neck, causing severe fractures in his skull, face, and neck.
During the delivery process, the baby’s body and legs were delivered, but his head remained trapped in the vaginal canal, leading to devastating consequences.
According to their attorneys, the couple faced additional trauma when medical personnel at the hospital allegedly misled them about the circumstances of the labor. They claim staff discouraged the couple from seeking an autopsy, pushed them to cremate the baby’s remains, and failed to report the death to the medical examiner, raising serious ethical concerns.
In their desperate search for clarity regarding their loss, Ross and Taylor hired Dr. Gates to conduct a private autopsy. However, the situation escalated further when, weeks after the tragedy, Gates reportedly shared explicit photos and videos of the child’s face and internal organs on Instagram without the parents’ consent.
In an emotional statement to FOX 5, Ross said, “My baby was on Instagram. Dr. Gates posted pictures of my baby,” emphasizing the profound violation of their privacy.
The lawsuit against Dr. Gates was filed in September 2023 after the couple issued a cease-and-desist letter demanding the removal of the posts. Allegedly, Gates reposted the controversial images even after receiving this warning, claiming that the material was intended for educational purposes and did not disclose the child’s identity.
The jury’s ruling is a crucial step towards holding medical professionals accountable for their actions. The couple’s attorneys stated, “While we are pleased that a jury punished Dr. Jackson Gates for his reprehensible behavior, nothing can ease the pain that the parents have experienced in losing their baby boy in such a horrific way.”
They further expressed a commitment to ensure that Gates faced consequences for his lack of empathy and the egregious invasion of the family’s privacy.
In a somber end to this tragic case, the Clayton County Medical Examiner’s Office previously ruled the child’s death a homicide this year, highlighting further issues related to the care provided during the delivery. Meanwhile, the legal actions against the hospital and the physician responsible for the birth remain unresolved, with no trial date set as of yet.
Attempts to contact Southern Regional Medical Center for comment have gone unanswered, reflecting the sensitivity surrounding this high-profile case. Similarly, Dr. Gates’ attorneys have yet to provide a statement regarding the jury’s findings.
