Several key provisions in the Senate GOP’s proposed legislation, often referred to as President Donald Trump’s big, beautiful bill, have hit a snag with Senate regulations. If Republicans wish to pass this extensive package without Democratic assistance, they must eliminate these problematic sections.

The legislation is currently undergoing a comprehensive review known as a Byrd Bath. During this process, the parliamentarian scrutinizes each element to ensure compliance with the Senate’s Byrd Rule, a guideline intended to maintain the integrity of budget reconciliation procedures.

The budget reconciliation process allows lawmakers to bypass the typical Senate filibuster, enabling the passage of significant partisan measures. However, if any sections fail to meet the established criteria, Senate Republicans will face the challenge of securing the standard 60 votes for approval. Even so, provisions that do not initially pass scrutiny can be appealed, adding a layer of complexity to the process.

Democrats Seize Opportunity to Challenge Republicans

Senate Democrats have pledged to leverage the Byrd Bath as a strategic tool. Their aim is to inflict maximum political pain on the Senate GOP while slowing down momentum as Republicans aim to deliver the substantial bill to Trump before July 4.

Senate Majority Leader John Thune, a Republican from South Dakota, holds the authority to overrule the parliamentarian’s decisions. However, he has consistently expressed his intention not to pursue such actions.

Parliamentarian’s Scrutiny Reveals Multiple Failures

Senate Parliamentarian Elizabeth MacDonough has carefully examined portions of the sweeping legislation from three committees—the Banking, Environment and Public Works, and Armed Services. Her review uncovered various policies that do not conform to the Byrd Rule.

One notable provision aimed to eliminate funding for the Consumer Financial Protection Bureau, a target of GOP efforts since its establishment in 2008. This change would have effectively dismantled the agency and reduced federal spending by $6.4 billion.

Tim Scott, the Chairman of the Senate Banking Committee, asserted his dedication to combating wasteful spending within the CFPB, emphasizing his commitment to collaborate with the parliamentarian on the committee’s provisions.

Unsuccessful Attempts to Manage Funding and Regulations

Additionally, Republican efforts to impose accountability measures on the $150 billion slated for Defense Department funding were also rejected. The proposed language required Pentagon officials to provide detailed accounts of expenditure plans by a specified deadline; failure to comply would result in funding reductions.

Other elements facing elimination encompass a plan to cut $300 million from the Financial Research Fund and reduce jobs by consolidating the Public Company Accounting Oversight Board under the Securities and Exchange Commission. This measure could potentially save around $773 million in federal costs.

Further, an initiative to revise the pay schedule for Federal Reserve employees also did not pass muster, which would have saved roughly $1.4 billion. Environmental regulations established by the Biden-era Inflation Reduction Act similarly failed scrutiny. Notably, a proposal to repeal tailpipe emissions standards for vehicles manufactured in 2027 and beyond was deemed non-compliant with the Byrd Rule.

The inclusion of several contentious provisions has created significant challenges for Senate Republicans as they navigate the legislative landscape. With deadlines looming and partisan tensions escalating, the stakes are high.

Senate GOP leaders must now consider alternative strategies to salvage key aspects of the legislation while adhering to the Byrd Rule. Their ability to negotiate and modify provisions could determine the ultimate fate of Trump’s ambitious legislative agenda.
