Investigation Launched Into Former Special Counsel Jack Smith by U.S. Office of Special Counsel

The U.S. Office of Special Counsel has initiated an investigation into former special counsel Jack Smith, as confirmed by the OSC in a statement to Fox News.

In 2022, then-Attorney General Merrick Garland appointed Smith to oversee two critical probes concerning former President Donald Trump. Smith’s appointment aimed to address complex legal issues surrounding Trump and his administration.

The OSC’s investigation centers on allegations that Smith may have violated the Hatch Act. This federal law prohibits government employees from engaging in political activities while in office. It is essential to note that this inquiry is not recognized as a criminal investigation.

Fox News Digital reached out to the White House for comments regarding the investigation on Saturday but received no official response.

The Office of Special Counsel operates independently from special counsels appointed by the Attorney General. It serves as a federal investigative and prosecutorial agency with distinct authority and responsibilities. According to the OSC’s official website, its statutory powers derive from various federal laws, including the Civil Service Reform Act and the Whistleblower Protection Act.

Additionally, the OSC enforces the provisions of the Hatch Act and the Uniformed Services Employment and Reemployment Rights Act (USERRA). Its role is crucial in maintaining the integrity of the public service and ensuring that political neutrality is upheld among federal employees.

Concerns regarding Smith’s conduct have heightened in the wake of political tensions surrounding the upcoming 2024 presidential election. Recently, Republican Senator Tom Cotton of Arkansas urged the OSC to investigate whether Smith acted politically to influence the electoral process against Trump.

In a letter dated July 30, Cotton formally requested an inquiry into Smith’s actions, highlighting the potential implications of political interference in the election. He emphasized the importance of maintaining a fair and unbiased electoral process, free from unlawful political manipulations.

In his correspondence to Acting Special Counsel Jamieson Greer, Cotton stated, “I write requesting the Office of Special Counsel to investigate whether Jack Smith engaged in unlawful political actions aimed at harming then-candidate President Donald Trump in the 2024 election.” This request underscores the growing scrutiny of Smith and his team during a politically charged time.

Furthermore, Cotton asserted that Smith’s past decisions and actions should be examined thoroughly to establish whether any unlawful influence occurred. He remarked, “President Trump of course vanquished Joe Biden, Jack Smith, and every Democrat who weaponized the law against him, but President Trump’s astounding victory doesn’t excuse Smith of responsibility for his unlawful election interference.”

Cotton’s appeal to the OSC reflects broader concerns among Republican lawmakers regarding perceived biases in investigations concerning Trump. The investigation into Smith represents another chapter in the ongoing saga of political rivalry and scrutiny facing both former President Trump and the legal teams involved in probing his conduct.

As the investigation progresses, the public awaits further developments. The implications of this inquiry may have significant repercussions for Smith, the Office of Special Counsel, and the political landscape as the 2024 election approaches.

With a focus on enhancing transparency and accountability within the government, the OSC plays a vital role in ensuring that political neutrality is preserved among public servants. The outcome of the investigation into Jack Smith will be closely monitored, both by legal experts and the general public alike.
