Jury Awards $205 Million to Family After Fatal Theme Park Ride Accident

A Colorado jury has rendered a historic verdict, mandating a local theme park and other defendants to pay $205 million to the family of a six-year-old girl who tragically fell over 100 feet from a ride. This ruling, issued on Friday in Garfield County District Court, stands as one of the largest wrongful death awards for an individual plaintiff in the history of Colorado.

Tragedy Strikes at Glenwood Caverns Adventure Park

Wongel Estifanos, a resident of Colorado Springs, was visiting Glenwood Caverns Adventure Park with her family during the Labor Day weekend in 2021 when the unthinkable happened on the Haunted Mine Drop. Documents reviewed indicate that Estifanos was not properly buckled into her seat prior to the ride’s start.

Instead of being secured, she was positioned atop the restraints of a previous rider. A warning alarm activated, yet an operator manually overrode the safety protocol and initiated the ride commencement, as confirmed by investigation files.

The Haunted Mine Drop Experience

The Haunted Mine Drop, renowned for being the first ride of its kind to plunge passengers underground, featured a thrilling drop of 110 feet into a dimly lit shaft. Riders sat together in a bench-like seat within a cavernous chamber. Once fastened with seat belts, the lights flickered out, simulating a ghostly ambiance that heightened the thrill as riders plunged downward in complete darkness.

After the swift descent, glowing lanterns would illuminate the mine walls before bringing riders back to the loading platform.

Permanently Closed Following Incident

Following the fatal incident involving Estifanos in 2021, the Haunted Mine Drop has remained permanently closed. “For four long years, Glenwood Caverns has denied any accountability for Wongel’s tragic death as she fell ten stories from the ride. Wongel’s parents pursued this case in court to unveil what transpired and to protect others from enduring similar heartache,” stated attorney Chris Caplis.

Allegations of Negligence and Safety Failures

The family’s lawsuit, filed in 2022, asserted claims not only of operator negligence but also of Glenwood Caverns’ negligence for ignoring numerous customer complaints regarding unsafe conditions on the ride. Investigators identified multiple errors on the staff’s part, which included failing to ensure the seat belts were properly prepared before boarding commenced.

Manufacturer Blamed for Defective Equipment

Kimberly Marcum, the marketing director for Glenwood Caverns, publicly stated that co-defendant Soaring Eagle Inc. had produced the Haunted Mine Drop with a faulty restraint system that contributed to this tragic incident. Marcum pointed to the manufacturer’s certification that claimed the attraction was safe, despite the apparent defects in its design.

In her remarks, Marcum expressed sympathy for the Estifanos family, stating, “Our hearts go out to the family of Wongel Estifanos,” while also noting that Glenwood Caverns is exploring various options to continue serving guests and supporting the local community.

No Criminal Charges Filed

Although prosecutors decided against pursuing criminal charges against Glenwood Caverns due to difficulties in establishing manslaughter, the civil trial provided a platform for Estifanos’ family to seek justice. “They are thankful to the residents of Garfield County for their kindness throughout this lengthy trial,” added attorney Caplis.

A Step Towards Accountability

The verdict not only provides financial compensation but also signifies a critical moment in advocating for ride safety regulations. It underscores the importance of ensuring that amusement parks are held accountable for their operational practices. As the case resonates with families across Colorado and beyond, it raises awareness about the significance of safety protocols in the amusement park industry.

The tragic history of the Haunted Mine Drop serves as a reminder of the potential dangers associated with amusement park rides. It illustrates the necessity for stringent safety measures and thorough inspections to prevent future accidents.

As community members reflect on this incident, their thoughts remain with the Estifanos family, who have endured unimaginable grief. Wongel’s tragic story is a call to action for the amusement industry and regulatory bodies to strengthen safety measures, ensuring that a similar tragedy is never repeated.

In a world where thrill-seeking adventures are enjoyed by families, incidents like this highlight the importance of safety and accountability, ensuring that all amusement park experiences are both enjoyable and secure.
