Virginia Attorney General Jason Miyares issued a detailed report that highlights what he describes as significant breaches of public policy by Fairfax County Commonwealth’s Attorney Steve Descano. This 33-page document, released on a recent Friday, sheds light on notable cases, particularly those involving transgender individuals, which have raised public outcry.
Descano, a Democrat in office, faces mounting criticism for seemingly lax prosecutorial judgment, especially in cases involving transgender defendants and repeated offenders. One case that caught significant media attention occurred at the Fair Oaks Mall, where a three-year-old girl was abducted by a man who had a history of offenses.
The suspect, Caceres Jaldin, allegedly took the child from a playground, leading to an urgent response from the guardians, who managed to locate him on a different floor of the mall. Virginia Governor Glenn Youngkin sharply criticized Fairfax officials over their management of the case, specifically questioning the wisdom of releasing Jaldin from prison prior to the incident.
Miyares underscored the seriousness of Jaldin’s prior actions, noting that he has been charged with 30 offenses since 2016. In 2022, reports indicated that Descano’s office made controversial decisions to dismiss two charges of malicious wounding against Jaldin.
The Attorney General’s focus on fairness in the judicial system came into view, especially after instances of clearer misconduct. In addition to the mall incident, criticism also surfaced around the handling of a rape case along the popular W&OD Trail, where the arrested suspect had a prolonged history of sexual assault convictions.
In a separate incident, authorities indicated that Descano’s office downgraded serious felony allegations to misdemeanors, potentially hindering justice. The local police chief discussed the impacts of these decisions on public safety in a statement to the media.
Amid these controversies, Miyares did not hesitate to express his disappointment in the handling of victims’ rights and the integrity of the legal process. He stated that justice should not be negotiable, presenting a stark contrast to Descano’s approach.
Miyares argued that Descano’s conduct represents a breach of the trust placed in him by the community, emphasizing his duty to uphold the law. Fairfax County, historically significant as the home of prominent figures like George Washington and George Mason, deserves competent legal representation.
