Two parents from Virginia are reporting that their three Jewish children faced expulsion from a prestigious private school after they raised concerns about antisemitic bullying aimed at one of their daughters.

The Nysmith School for the Gifted, located in Herndon, Virginia, has previously received accolades such as being named one of the “Top 10 Schools in the World” by the Johns Hopkins University Center for Talented Youth in 2015. The school has since rejected the parents’ claims of discrimination.

Filing with the Attorney General

A formal complaint has been submitted to the Virginia Attorney General’s Office for Civil Rights by Brian Vazquez and Ashok Roy, stating that their three children were expelled on March 13, following their complaints regarding the lack of school action against persistent antisemitic harassment directed at their 11-year-old daughter.

The complaint includes troubling evidence, such as a picture of students holding a cartoonish illustration resembling Adolf Hitler, which was allegedly part of a class project requiring drawings of “strong historical leaders.”

According to the complaint, the school environment permitted antisemitism to flourish. The document states, “This photo, featuring Hitler’s unmistakable face, was circulated within the school community and was part of a pattern of harassment against our daughter.”

Details of the Bullying

The parents asserted they met with Kenneth Nysmith, the school’s headmaster, to discuss the harassment their daughter faced, including insults related to recent global events. The complaint recounts how classmates bullied her with taunts connected to the October 7, 2023 Hamas attacks, which tragically claimed over 1,200 Israeli lives and involved hostage situations for others.

Reportedly, other students displayed pro-Palestinian stickers on school materials and ridiculed her for being “Israeli.” The targeted bullying became more severe, with students publicly labeling her as a “baby killer” and declaring that she deserved to die due to events unfolding in Gaza.

The complaint mentions Nysmith’s promises to address these issues but alleges that these commitments were not honored. The situation reportedly worsened when Nysmith hung a Palestinian flag in the school gym.

Retaliation and Immediate Expulsion

The parents assert that after voicing their concerns about the escalating harassment, Nysmith abruptly advised them to instruct their daughter to “toughen up” and terminated the meeting. Just two days later, they received an email announcing their children’s immediate expulsion, which occurred just prior to mid-semester report card evaluations and well after application deadlines closed for other local schools.

The couple’s children, ages 8 and 12, had been part of the Nysmith community since 2021 as high-achieving students without any prior disciplinary issues.

Wider Implications of Antisemitism

Jeffrey Lang, the family’s attorney from the Brandeis Human Rights Center, voiced concerns about this incident being a sign of the normalization of antisemitism within society. He remarked that such behavior should elicit a moral outrage response, stating, “This scenario illustrates a troubling trend – it’s not just happening on college campuses, but also in elementary schools.”

Lang explained that the parents were dedicated to working with the school to resolve the bullying issues. Their desire was to create a supportive environment for their daughter, not to leave the school altogether.

He emphasized the school’s role in providing a safe environment for all students, particularly those facing bullying. He said, “When children are in the school’s care, it should offer them support, rather than expelling an entire family in response to bullying.”

School’s Defense Against Allegations

Responding to the allegations, Nysmith disputed claims of wrongdoing, suggesting the accusations misrepresent the context of the controversial drawing. He stated that it was part of a social studies project focused on traits described in Machiavelli’s “The Prince,” and that one involved student has Jewish heritage with a grandmother who is a Holocaust survivor.

Nysmith also shared details about the school’s commitment to inclusivity, noting that the gym displays flags representing the diverse backgrounds of students. Despite this, he acknowledged parents’ desires for additional flag representation, including those for Palestine and Poland, while maintaining that the Israeli flag is prominently displayed alongside the American flag.

Allegations and Ongoing Investigation

The complaint alleges that the Nysmith School violated the Virginia Human Rights Act by engaging in unlawful antisemitic discrimination and retaliatory actions. Virginia Attorney General Jason Miyares, whose office is currently investigating these allegations, labeled the claims as extremely concerning. He pointed out that harassment against Jewish students has increasingly permeated the lower educational levels.

Miyares reinforced that every Virginia student deserves an educational environment free from harassment, stating, “If these allegations hold true, they reflect a serious violation of the Virginia Human Rights Act. Our mission is to ensure that no student fears for their safety based on their identity or beliefs.”

Miyares further noted the distinct approach being taken by Virginia compared to other states, aiming for a system where all students feel protected. He underscored the necessity for schools to actively combat any form of discrimination, especially in light of the rising tensions surrounding global issues.
