In her memoir titled “Strangers: A Memoir of Marriage,” Burden candidly discusses the prenup her attorney advised against, detailing the threats from her former spouse regarding minimal child support following his decision to relinquish custody of their children. She also shares her arduous journey of navigating this painful ordeal while adapting to a new way of life.
The daughter of Carter Burden, a descendant of the wealthy Vanderbilt family and a successful entrepreneur, and Amanda Burden, an accomplished urban planner and socialite, Burden entered her marriage with Henry Davis—whom she refers to as “James” in her book—armed with financial independence.
Davis, by contrast, was not born into wealth. Though a lawyer like Burden, he experienced a turbulent childhood marked by his father’s struggles with mental health and unemployment. Throughout their relationship, Burden noted how deeply his family’s financial difficulties impacted his ambitions and life choices.
Just three months after their initial kiss, James proposed. During their engagement, they opted to share living expenses equally while preparing for their 1999 wedding. Burden’s mother reminded her of the importance of drafting a prenup, an agreement both she and her brother established in their twenties.
Initially, the prenup outlined that both parties would retain ownership of their pre-marriage assets but would divide any earnings accumulated during the marriage in the event of a divorce. James expressed significant concern about this agreement, feeling it positioned him as an outsider and a potential threat. Burden, feeling guilty about the prenup’s implications, empathized with his concerns.
In a last-minute adjustment before their wedding, James proposed altering the prenup to allow them to keep earnings during the marriage while sharing ownership of property in both their names. Despite her lawyer’s strong advice against this risky change, Burden ultimately chose to proceed with her husband’s suggestion.
This decision would later have far-reaching implications. In 2001, Burden and James purchased a spacious four-bedroom apartment in Manhattan, with James listed as a co-owner despite his investment being nonexistent. Burden willingly tapped into her trusts for the purchase, trusting that her marital bond justified the arrangement.
A few years later, they bought a summer home in Martha’s Vineyard, again with James as a joint owner. Burden consistently supported James’s aspirations, even as he grew ambivalent about his parenting responsibilities after his promotion to president of his investment firm.
While Burden embraced motherhood, she started taking on pro bono immigration cases. Yet, she never returned to full-time employment. In 2012, an employment opportunity arose, but James dismissed the notion outright, insisting she needed to prioritize their children. Though frustrated, she ultimately respected his wishes.
As their marriage progressed, Burden contemplated revising the prenuptial agreement, recognizing the imbalance caused by her sacrifices for the family’s well-being. They planned a meeting with their attorney in July 2019 to address the prenup, but just before the meeting, James suggested postponing discussions and instead focus on their wills, expressing a desire to leave everything to Burden directly.
Less than a year later, Burden was blindsided when she discovered James’s affair while the family was isolating together during the early days of the COVID-19 pandemic. A voicemail from a man claiming his wife was involved with James signaled the start of a tumultuous reckoning.
When Burden confronted James, he admitted to everything and revealed he wanted a divorce. He left their home abruptly without saying goodbye to their children, ages 17, 15, and 12. The emotional toll was staggering as he expressed confusion about his happiness, conveying a desire to end their life together.
During subsequent discussions, James told Burden she could retain their home and full custody of the children, insisting he did not want them or the possessions, effectively abandoning his parental responsibilities. Despite paying bills, he asserted that the children were old enough to determine their own relationship with him.
In January 2021, during divorce proceedings, Burden uncovered the extent of James’s wealth and realized that the prenup, altered against her lawyer’s counsel, placed her at a significant disadvantage. She lamented, knowing that James could stake a claim to both properties and retain all his assets moving forward.
In a desperate bid for fairness, her attorney prepared a counterclaim, yet doubts loomed large. Burden grappled with whether it would be safer to let the divorce unfold without confrontation, hoping James would act with fairness.
However, trust began to erode, as Burden faced the reality of her former life falling apart. Six months later, the judge dismissed her counterclaim, reinforcing the prenup and setting a trial date to determine child support and the division of jointly owned assets. Following the dismissal, James grew increasingly volatile.
He insisted on providing only the minimum required child support, declaring Burden would have to face the consequences of their prenup. Afterward, she grappled with the prospect of selling both homes, realizing the devastating impact this would have on her children.
Ultimately, just an hour before their scheduled trial, Burden and James reached a settlement. He relinquished his interest in their properties and settled on child support and coverage for the kids’ medical expenses and education costs while retaining his earnings. Burden expressed gratitude for the outcome but couldn’t shake suspicions about James’s intentions.
Reflecting on the settlement, Burden explained her struggles with the emotional aftermath.
