The family of 26-year-old Elijah Wilks has come forward, expressing their belief that the off-duty Milwaukee officer involved in the fatal shooting acted appropriately during a recent traffic encounter. Video evidence reportedly shows Wilks striking the officer with a firearm and directing it at him prior to the shooting.
This tragic event unfolded around 8:30 a.m. last Thursday on West Mill Road, located on Milwaukee’s northwest side, according to police reports. The 41-year-old officer, who has dedicated 21 years to the Milwaukee Police Department, was engaged in a minor vehicle incident when the confrontation escalated.
Dashcam footage from the officer’s vehicle reveals a construction zone where drivers were instructed to merge. In this footage, witnesses see Wilks moving into the left lane and cutting off the officer’s vehicle.
B’Ivory Lamarr, the attorney representing Wilks’ family, provided insights during a conference held on Monday. He indicated that after the two drivers exchanged words, they both exited their vehicles to continue arguing, although their dialogue remained inaudible in the video.
As seen in the video, Wilks accused the officer of causing damage by pointing to the officer’s car. In a shocking turn, Lamarr recounted that Wilks then brandished a firearm and struck the off-duty officer with it—a moment also captured in the footage.
“The video we reviewed today, alongside his mother, clearly shows that he did hit the off-duty officer with a firearm,” Lamarr explained. “It shows Elijah pointing the firearm at the officer. In response, we believe the officer acted according to his training and discharged his weapon.”
Following this confrontation, dashcam footage depicts Wilks emerging from the opposite side of his vehicle as the officer fired additional shots, ultimately striking Wilks multiple times. He succumbed to his injuries at the scene.
During a press conference, family members expressed their concern regarding the lack of first aid administered by the officer following the shooting. Despite this, they affirmed that they believed the officer’s actions were justified in that context.
“It is important to address the circumstances we witnessed,” Lamarr remarked during the conference. “This is a unique situation for us, but we recognize that the officer’s actions were warranted.”
He emphasized that while the outcome of the shooting was undeniably tragic, the family publicly acknowledges the officer’s response.
In the aftermath of the shooting, the family reviewed the footage, coming to a collective belief that their loved one had made a grave error. “He was a good person… everyone loved my brother,” noted Elayjah Wilks, Elijah’s sister, reflecting the family’s sense of grief.
Andrea Ward, Elijah’s aunt, shared her thoughts on the tragic event. She stated, “This incident could have happened to anyone, highlighting how a single choice can dramatically alter lives.”
Latrice Bell, another aunt, added, “Elijah made a decision that he should not have made, and we must now deal with the consequences. While I don’t believe he recognized the officer, the encounter could have unfolded differently regardless.”
According to the policies of the Milwaukee Police Department, next of kin must have the opportunity to view video footage within 48 hours following a deadly incident. Additionally, the department is required to make relevant footage public within 15 days. In this instance, the footage was released to the public ahead of schedule, demonstrating a commitment to transparency.
Lamarr conveyed that the family’s decision to publicly acknowledge the officer’s actions was not made lightly. Nonetheless, he stressed the importance of accountability, transparency, and healing in a city grappling with the implications of gun violence.
The Milwaukee Police Department has not yet issued a comment regarding the incident. The community continues to reflect on the severe implications of this confrontation, underscoring the broader challenges of interactions between law enforcement and civilians in tense situations.
