The Purpose of the U.S. Cyber Trust Mark Program

Established in 2024, the U.S. Cyber Trust Mark aims to function as a voluntary device testing program. This initiative, which received unanimous approval from the Biden administration, is designed to provide consumers with a recognizable safety label on Internet of Things (IoT) devices. These could include home security cameras, smart TVs, internet-connected appliances, fitness trackers, and baby monitors sold in the U.S.

The intent behind the Cyber Trust Mark is to assure consumers that devices meet specific security standards established by the National Institute of Standards and Technology. This program was meant to simplify informed decision-making regarding device safety.

Concerns Raised about the Program’s Quick Rollout

An insider at the FCC disclosed that the Biden administration may have rushed the project, leaving it in a state of uncertainty. Brendan Carr, the Trump-appointed FCC chairman, initially supported the program. UL Solutions LLC was designated as the Lead Administrator for the U.S. Cyber Trust Mark under the Biden administration. Additionally, UL Solutions will be tasked with public education about the program’s importance.

Investigation into UL Solutions and Ties to China

Chairman Carr has instructed the Council on National Security to investigate troubling findings related to UL Solutions LLC and other Cybersecurity Label Administrators, particularly concerning their links to China. The document indicates that Carr is evaluating next steps to prevent the U.S. Cyber Trust Mark program from inadvertently providing a pathway for Chinese Communist Party interference.

The document elaborates that Chinese IoT products, including those utilizing Chinese components, can currently receive the Cyber Trust Mark just as easily as American products. While UL Solutions is based in the U.S., the document underscores that it maintains critical connections to China.

Joint Ventures and Chinese Connections

According to the FCC’s internal document, UL Solutions engages in a joint venture with the China National Import and Export Commodities Inspection Corporation. Due to this association, UL Solutions will be excluded from the FCC’s equipment authorization program following newly instituted guidelines.

Furthermore, UL Solutions operates 18 testing locations across China, with three sites identified as particularly concerning. The document notes that UL Solutions has not distanced itself from its relationships in China since gaining approval to oversee the initiative.

Michigan Republican Representative John Moolenaar chairs the House Select Committee on Strategic Competition between the United States and China. He has expressed support for the FCC’s efforts to bolster the Cyber Trust Mark program. Moolenaar emphasized the necessity for consumers to be aware of device security, condemning the potential risks posed by the current framework.

The representative stated that allowing Chinese companies with ties to the CCP to attain U.S. government-backed certification could mislead consumers and create dangerous vulnerabilities within American networks. He commended Chairman Carr for ringing the alarm on these issues, urging for enhancements that fortify U.S. defenses rather than compromising them.

Additionally, the FCC highlighted troubling connections among several Cybersecurity Label Administrators selected during the Biden administration. Some of these organizations have notable affiliations with China, further complicating the landscape of U.S. cybersecurity.
