A federal district judge in Indiana has ordered the state’s Department of Correction to arrange sex reassignment surgery for a transgender inmate convicted of homicide. This ruling represents the latest chapter in a legal battle over Indiana law, which currently prohibits the use of taxpayer funds for such procedures.
The case revolves around Autumn Cordellioné, previously known as Jonathan Richardson, who filed a request for sex reassignment surgery following her conviction for the reckless homicide of an infant. The American Civil Liberties Union initiated the lawsuit against the Indiana Department of Corrections in 2023, challenging the constitutionality of the state law that bars funding for gender-affirming surgeries in prison.
The ACLU argues that the law violates the Eighth Amendment, which prohibits cruel and unusual punishment. In a ruling on March 5, Judge Richard Young emphasized the need for immediate action, stating that the Commissioner of the Indiana Department of Correction must take all reasonable steps to secure the necessary gender-affirming surgery.
