California Governor Gavin Newsom’s office has issued a statement addressing the recent lawsuit filed by the U.S. Department of Justice against the California Department of Education and the California Interscholastic Federation. This lawsuit centers around alleged violations of Title IX relating to transgender athletes competing in girls’ sports.
In a post shared on X, Newsom’s press office clarified that the governor is not named in the lawsuit. The statement noted that many individuals have recently assumed the role of legal experts, and emphasized that the governor’s lack of inclusion as a party in this legal matter is significant.
“Since a lot of folks on here have become legal experts in the last few hours, I would point out the Governor is not named as a party in this lawsuit,” the post stated.
While the post refrained from addressing the moral implications of allowing biological males to compete in girls’ sports, it defended California’s current policies. Newsom’s office articulated that both the California Department of Education and the California Interscholastic Federation operate independently of the Newsom administration. They asserted that these organizations are adhering to established state law.
“The California Department of Education and CIF are both independent from the Newsom administration, and they are following existing state law — a law that was passed in 2013, signed by Governor Jerry Brown,” the statement explained. “This is in line with 21 other states. No court has adopted the interpretation of Title IX that is being advanced by the Trump administration, and neither the Governor, nor they, get to wave a magic wand and override it. Unlike Donald Trump, California follows the law, not personal opinions.”
The press release elicited criticism on social media as discussions around the topic intensified. Recent comments from Governor Newsom indicate an ongoing struggle with the issue of fairness regarding transgender athletes. During a public event in South Carolina, Newsom shared his thoughts on the matter.
“I struggled with the issue of fairness when it came to sports,” he stated. “We tried to figure that out a couple of years ago, and we were unsuccessful, and we struggled with that recently.”
He also emphasized his opposition to derogatory language aimed at the transgender community. “And my position is that I don’t think it’s fair, but I also think it’s demeaning to talk down to people, and to belittle the trans community. These people just want to survive,” he said, underscoring the importance of treating individuals with respect.
The Department of Justice’s lawsuit seeks an injunction against California’s policy that permits male athletes to compete against females in sports. The lawsuit argues that California’s policies undermine equal athletic opportunities for girls and create a hostile educational environment by requiring girls to share facilities with males.
As stated in the lawsuit, “The results of these illegal policies are stark: girls are displaced from podiums, denied awards, and miss out on critical visibility for college scholarships and recognition.”
California’s policies currently allow athletes to participate in sports that align with their declared gender identity. State officials maintain that this practice does not contravene the Equal Protection Clause of the Fourteenth Amendment.
The California Interscholastic Federation has not commented on ongoing legal matters, while the California Department of Education has also refrained from discussing pending litigation.
Recently, the U.S. Education Department determined that California was in violation of Title IX. Despite this, both the California Department of Education and the California Interscholastic Federation declined to sign a proposed resolution agreement, which led to the current legal dispute. They were given a deadline to comply with these demands but refused, prompting this legal action.
This lawsuit marks a significant development as it is the second legal initiative brought forth by the Department of Justice over issues surrounding transgender athletes, following a similar lawsuit against the state of Maine earlier this year.
