High School Suspension Over MAGA Hat Sparks Controversy in Southern California

An Orange County high school student experienced suspension after wearing a “Make America Great Again” hat that ignited a political dispute with a fellow student.

Zach Hornstein, a student at Laguna Beach High School, communicated to Fox News Digital about the incident that unfolded on September 11. Along with friends, he donned MAGA hats to honor Charlie Kirk, a co-founder of Turning Point USA. Kirk was tragically shot during a speaking event at a Utah college the day prior.

Hornstein expressed, “His death really affected us. I may not agree with everything he says, but I appreciate that he encourages students to think critically and engage in honest discussions. My mom is an immigrant, and I was raised to love America. On September 11, I wanted to feel patriotic and show my support for our country as a whole.”

The situation escalated at the end of the school day when a female student seized Hornstein’s hat and discarded it in the girls’ bathroom trash can. A subsequent argument erupted, during which she used profanity concerning President Donald Trump, as reported by KTTV-TV, Fox 11 Los Angeles.

Despite the emotional turmoil, Hornstein noted that the group “got over it and moved on.” At the suggestion of a teacher, he submitted an incident report and requested a written apology. Ultimately, both students received suspensions.

Describing the suspension as “extremely upsetting,” Hornstein voiced concerns about how it interfered with his intensive Advanced Placement classes. “To this day, I do not understand what I was actually suspended for,” he mentioned. He added that during the argument, he humorously stated, “If you don’t like America, Canada has open borders,” a comment confirmed by witnesses, including the girl who had removed his hat.

Interestingly, Hornstein reaffirmed his friendship with the other student and doubted the school administrators’ decisions. “She was suspended as well, and I believe that it was a complete overreaction. It was an emotionally charged day for everyone on September 11, and she made a mistake for which she later apologized,” he remarked.

Furthermore, he emphasized their ability to work through the disagreement in a healthy manner while wishing the adults involved had demonstrated a similar approach. His mother, Janet Semenova, highlighted her son’s status as an honor roll student with no prior disciplinary incidents.

She voiced her belief that Zach was singled out due to his political beliefs. “I think it’s a double standard,” Semenova shared with Fox11. “I believe that kids with certain political views are held to a different standard compared to those with opposing views.”

The Laguna Beach Unified School District clarified that it does not penalize students for expressing political opinions. A spokesperson for the district stated, “We are legally required to maintain confidentiality concerning student discipline matters to protect the privacy and well-being of all students. Upholding free expression is fundamental to our democracy, and schools have a crucial role in helping young people navigate diverse viewpoints respectfully.”

The spokesperson continued, “Our responsibility as educators is to guide students in engaging in constructive dialogue and healthy debate that is rooted in civility. High school is a critical time for growth, and we are committed to fostering thoughtful citizens who understand both their rights and responsibilities within a diverse community.”

In instances of disputes on campus, the district must assess the behaviors involved. California law specifies grounds for suspension, and the district is currently reviewing the situation to ensure fairness and consistency.

Interestingly, the district’s dress code does not prohibit students from sporting political apparel. Hornstein confirmed that students are permitted to wear clothing conveying political messages as long as the attire remains appropriate.

In response to the incident, Semenova indicated that the family intends to appeal the suspension before the school board. “We deeply appreciate this school and its teachers, which amplifies our disappointment in the administration’s handling of this sensitive matter,” she expressed. “What we truly desire is acknowledgment from the school that they could have approached this situation better, using it as a learning opportunity rather than one that exacerbated division. It is challenging being a teenager, and I believe our moral responsibility is to guide them to become more empathetic and tolerant adults. In this regard, perhaps we can all learn a lesson from the late Charlie Kirk.”
