After Dr. Kevin O’Connor, the former White House physician, appeared before House investigators on Wednesday, his attorneys issued a statement advocating for the cessation of Comer’s probe while a related federal investigation is underway.

Comer expressed skepticism about the motive behind this request, stating it was simply a tactic designed to prevent testimony concerning the alleged cover-up of President Biden’s cognitive decline.

He continued, “We called for his testimony over a year ago, but the Biden White House obstructed his appearance before the Oversight Committee. Now that we have compelled him to testify and the White House has waived executive privilege, Dr. O’Connor is resorting to the Fifth Amendment to keep the facts obscured.”

Comer pointed out that there is a longstanding precedent for concurrent investigations by Congress and the Department of Justice. He issued a subpoena to O’Connor as part of his committee’s efforts to determine whether decisions made during the Biden administration were finalized using an autopen and whether President Biden was aware of these actions.

An aide from the Oversight Committee countered by explaining that a legitimate doctor-patient objection would have allowed him to remain and respond to questions that did not circumvent such privilege. “Instead, he chose to invoke the Fifth on all matters,” the aide stated.

The attorney’s statement further noted, “This Committee has informed Dr. O’Connor and his legal counsel that it does not plan to respect one of the most recognized privileges in our legal framework—the physician-patient privilege. The Committee has indicated it will demand Dr. O’Connor reveal confidential information regarding his medical evaluations, treatments, and care of President Biden without any caveats.”
