The ruling emerges from a legal dispute where Lively’s legal team sought to subpoena the phone records of Baldoni and others related to allegations of a smear campaign intended to damage the actress’ reputation. Attorney Bryan Freedman, representing Baldoni, described the court’s decision as a substantial victory, stating, ‘The Court put a stop to Ms. Lively’s egregious attempt to invade our clients’ privacy.’ He further emphasized that this ruling could serve to diminish any ongoing efforts by Lively’s team to discredit their clients in light of the accusations.

Legal Staff Responds to Ruling

The judge’s refusal to approve Lively’s request specifically for Baldoni’s records does not mean she is entirely restricted. Liman noted that Lively could still pursue records from individuals who are not parties to the case. This potential path reflects the delicate balance between privacy rights and discovery in legal proceedings.

‘This request implicates legitimate privacy interests,’ the judge wrote, highlighting that even if Lively attempted to limit the scope of her request to exclude call content, the records could still reveal sensitive information about personal communications, including medical professionals and acquaintances.

Despite the setback, Lively was given the opportunity to make tailored discovery requests to gather information from others potentially involved in the alleged plot against her.

In his detailed ruling, Judge Liman elaborated, ‘Lively may make discovery requests tailored to those individuals. She is permitted to use discovery tools to identify contact information or telephone numbers for those individuals.’ However, he cautioned that extensive subpoenas could not be justified without sufficient cause.

He added, ‘The Wayfarer Parties may assert a privacy interest in their own phone records, but they have not provided any basis for asserting an interest in the communications of non-parties.’

Lively’s Legal Team Responds

Lively’s representatives expressed determination in continuing their legal course despite the judge’s ruling. Following the order, they announced plans to submit specific requests for records directly to the relevant defendants.

A spokesperson for Lively stated, ‘What is Bryan Freedman hiding? After promising to release all the ‘receipts,’ Freedman ran into court to keep secret the phone records of those involved during their retaliatory campaign.’

The spokesperson added, ‘Today we will do that; we are submitting those requests directly to defendants involved, and we look forward to seeing the records.’
