Kathy Hochul Stirs Controversy Over Transgender Murder Investigation Despite Lack of Evidence for Hate Crime Motive

New York Governor Kathy Hochul has ignited speculation regarding a hate crime in the tragic slaying of 24-year-old Sam Nordquist, a transgender individual. This comes even as both the Ontario County District Attorney’s office and state police have stated there is no evidence supporting such a motive.

In a statement released on Sunday, Hochul emphasized that she has instructed the State Police to provide comprehensive support and resources to the District Attorney’s office as the investigation proceeds. Hochul particularly noted the importance of exploring whether this incident could be classified as a hate crime.

This statement was issued the same day as a joint announcement from the New York State Police and the Ontario County District Attorney’s office. On Friday, state police discovered Nordquist’s remains in Yates County, illuminating a case that has raised serious concerns both locally and across the state.

The joint release from authorities maintained, however, that there is currently no indication that Nordquist’s murder was motivated by hate. They noted that the victim and the accused were acquainted and identified as LGBTQ+. In fact, at least one of the defendants had lived with Nordquist in the time leading up to his tragic death.

Details Surrounding the Murder Investigation

Law enforcement officials have charged five individuals in connection with Nordquist’s death. Those arrested include Precious Arzuaga, 38; Jennifer A. Quijano, 30; Kyle Sage, 33; Patrick A. Goodwin, 30; and Emily Motyka, 19. Each has been charged with second-degree murder with depraved indifference, a significant allegation in this ongoing investigation.

Criminal Backgrounds of the Suspects

Reports indicate that three of the suspects have prior criminal records, which span from child sex crimes to theft. Arzuaga has faced four misdemeanor convictions, including petty larceny and criminal trespass. Sage has a conviction for larceny and distributing indecent material to a minor, with state records showing he was on parole at the time of his arrest.

Goodwin presents a particularly concerning case; he is a registered Level 3 sex offender based on a conviction for a first-degree criminal sexual act involving a victim under the age of 11, which led to a sentence of 10.5 years in prison. After his release, he was placed on parole in June 2023.

The current status of Arzuaga, Quijano, and Motyka remains unclear within the New York State corrections system.

Understanding Hate Crimes in New York

In New York, hate crimes are defined under Penal Law Section 485.05 as offenses committed in substantial part due to a person’s race, color, national origin, gender, gender identity, religion, age, disability, or sexual orientation. This legal framework underscores the importance of establishing motive in cases labeled as hate crimes.

Retired New York Police Department inspector Paul Mauro shared insights with Fox News Digital, suggesting that if current evidence does not present a strong hate crime motive, the prosecution is likely to proceed with regular murder charges. He raised questions about the motivations behind Hochul’s comments in light of the evidence available at this time.

Family and Community Response

Authorities confirmed that Nordquist’s family last communicated with him at the end of January. A missing person investigation was initiated after the family requested a welfare check last week. The discovery of Nordquist’s body in a Yates County field has sent shockwaves through the community, prompting discussions about safety and violence against LGBTQ+ individuals.

Officials believe that Nordquist experienced significant abuse, both physical and psychological, leading up to his death. This aspect has heightened the community’s concern and sorrow over the circumstances surrounding this crime.

The Governor’s Reaction

Governor Hochul has characterized Nordquist’s murder as
