EXCLUSIVE: A Maryland Supreme Court justice appointed by a Democratic governor is facing significant criticism due to a Halloween display that has raised questions about his impartiality. Critics argue that the display may cast doubt on his ability to rule fairly in an important environmental case currently before the court.
Justice Peter Killough, who was appointed to the Maryland Supreme Court by Governor Wes Moore, has displayed overtly political messages on his lawn during the Halloween season. This comes at a critical time as he is poised to hear a pivotal case related to environmental issues.
The Halloween display features signs that convey strong left-wing political sentiments. Among them are gravestones adorned with messages such as, “Here lies the Constitution,” “RIP Freedom of Speech,” and “Beware Health Insurance Cuts.” An environmentalist sign stands out, indicating his personal views at a time when he is involved in a significant environmental lawsuit.
Justice Killough is currently part of the Maryland Supreme Court that is deliberating on the case of Mayor & City Council of Baltimore v. BP P.L.C. In this lawsuit, Baltimore city officials accuse major oil companies of misleading the public regarding the impacts of fossil fuels on climate change, claiming that the companies contributed to costly damages from sea-level rise and extreme weather events.
Nick Cavey, a spokesperson for the Maryland Judiciary, stated that the signs belong to Justice Killough’s wife and emphasized that Killough has no further comments. Nevertheless, the juxtaposition of his personal display and his judicial responsibilities raises alarms.
In an exclusive interview, former Arizona Supreme Court Justice Andrew Gould expressed profound concern about the implications of Killough’s display. He described the signs as indicative of a bias that should disqualify Killough from participating in such a high-profile case.
Gould remarked, “It has cast a shadow over the decision now. The public, no matter their stance, will inevitably feel distrust towards the proceedings.” Such expressions of personal belief by those in judicial roles can undermine the foundation of impartiality required in the legal system.
Gould shared his shock and disappointment upon seeing the display, stating that if the judge holds such strong political views, he should have recused himself from the case. “Once the case has been argued and documents submitted, how does one un-ring the bell?” he questioned, emphasizing the challenge of restoring public confidence after such incidents.
This controversy is not Justice Killough’s first encounter with criticism. In 2022, while serving as a circuit court judge in Prince George’s County, he faced backlash over his handling of juvenile cases. Officials accused him of being lenient with serious offenders, leading to his reassignment away from juvenile cases.
In a particularly alarming instance, Killough granted probation to a 12-year-old who confessed to a homicide. The victim’s mother expressed her anger, feeling disrespected by the proceedings as Killough appeared detached and unconcerned.
While Killough’s Halloween display has sparked considerable debate, it is part of a broader trend of judges facing scrutiny for their personal beliefs influencing their roles in the courtroom. Gould warned of an alarming increase of judges feeling compelled to voice personal opinions in their rulings, particularly those opposing former President Trump.
He emphasized that judges must separate personal biases from their rulings, as doing so is essential for maintaining public trust. “People need to believe that judges are fair and have not prejudged cases. This incident in Maryland will only deepen public distrust,” Gould stated.
The issues raised by Justice Killough’s display reflect a broader anxiety regarding the perception of impartiality within the judiciary. As judges increasingly share personal beliefs, the integrity of the legal system may come under threat. Trust in judicial decisions hinges on the public’s confidence that rulings are based on law and facts rather than personal agendas.
Former Justice Gould concluded by reiterating the importance of judicial neutrality, stressing that judges must strive to uphold their oaths and ensure fairness in all proceedings.
