Parents Group Urges Trump Administration to Scrap Controversial Biden-Era Discipline Policies

FIRST ON FOX: A grassroots parental rights advocacy group, Parents Defending Education (PDE), is calling on the Trump administration to overturn what they deem “unconstitutional” policies from the Biden era. These policies penalize educational institutions for perceived racial disparities in student discipline, as highlighted in a 2023 Dear Colleague letter from the Department of Justice (DOJ) and the Department of Education (DOE).

PDE argues that the Biden administration’s directive presses schools to adopt what they see as “racially discriminatory discipline policies” or risk losing federal funding.

In a letter addressed to Secretary of Education Linda McMahon, PDE noted that even with clear Supreme Court rulings stating that disparate impact does not alone constitute a Title VI violation, the School Discipline Letter incorrectly asserts that racial disparities in school discipline outcomes serve as prima facie evidence of racial discrimination. This occurs even when a school’s disciplinary code remains neutral with respect to race. Furthermore, PDE emphasized that the letter threatens school districts with federal funding cuts if they do not modify their practices to reduce such disparities.

Biden Administration’s Emphasis on Racial Equity in Education

The Biden administration’s DOJ, along with the DOE’s Office for Civil Rights, issued guidance in 2023 aimed at addressing racial discrimination in K-12 school discipline. This measure aims to ensure fair treatment of all students, irrespective of race.

Then-Assistant Attorney General Kristen Clarke stressed the long-lasting impact of discriminatory discipline on students. In a DOJ release, she asserted that discriminatory practices in school discipline could severely hinder students’ future opportunities.

Clarke stated that the DOJ utilizes federal civil rights laws to combat discrimination in various disciplinary actions, including suspensions, expulsions, law enforcement referrals, and arrests in school settings. She emphasized that a range of factors can contribute to this discrimination, reflecting the department’s commitment to safeguarding all students’ rights.

Decades of Enforcement Highlighted in the Letter

The letter issued by the DOE and DOJ outlined their historical commitment to combating discrimination in student discipline. It underscored that these agencies have engaged in decades of enforcement activities aimed at curbing racial bias within educational institutions.

According to the agencies, significant disparities in discipline based on race, starting as early as preschool, demonstrate an ongoing concern that must be addressed. They maintained that while mere racial disparities do not violate existing laws, it is crucial to investigate the underlying reasons that contribute to these discrepancies.

Criticism of Biden Era Practices

PDE spokesperson Erika Sanzi expressed disbelief at the previous administration’s approach, which involved instructing schools to implement policies that PDE views as racially discriminatory. She criticized the notion that schools should face penalties for failing to align with these practices.

At the time of the guidance’s release, investigations into14 school districts spanning 10 states were underway. These investigations sought to determine whether schools had unfairly disciplined Black, Latino, and Native American students through measures such as suspensions and expulsions.

Sanzi remarked that it was not surprising to see school districts hesitate to impose suspension on certain racial groups, particularly because of behavior classified as chronically disruptive or violent. She argued that this hesitation ultimately led to chaos within many schools. Sanzi called for an immediate retraction of the guidance, advocating for policies that prioritize race neutrality.

The Current State of Federal Education Policy

The DOE, which President Trump aims to overhaul, has shifted away from many of the previous administration’s initiatives related to diversity, equity, and inclusion during the initial months of Trump’s presidency. Recently, the department commenced an investigation into 60 universities over allegations of antisemitism and violence against Jewish students following the tragic events in Israel on October 7, 2023.

A Call for Action

The pressing issue raised by PDE underscores a broader debate about the balance between addressing racial disparities in education and ensuring the application of discipline policies that are inherently neutral. The push from the parents’ group for the Trump administration to overturn Biden-era policies reflects a fundamental clash in educational philosophy.

Advocates for traditional discipline protocols argue that it is vital to maintain order and fairness in educational settings while identifying and rectifying genuine instances of racial bias.
