EXCLUSIVE: In a significant development, Republican lawmakers are pressing for an investigation into President Biden’s dismissal of a lawsuit that alleges fraud involving millions in taxpayer dollars related to a green energy project. This lawsuit was notably dismissed just one day after the presidential election in 2024.
The controversy traces back to 2011 when President Barack Obama’s Treasury Department awarded hundreds of millions of dollars to Tonopah Solar Energy, LLC for the development of the Crescent Dunes Solar Energy Project in Nevada.
However, this energy initiative faced legal troubles when CMB Export, LLC filed a qui tam lawsuit. This type of lawsuit allows individuals to sue on behalf of the government for fraud against federal programs. The case, which alleged fraud involving approximately $275 million of taxpayer funds, was under investigation by the Department of Justice (DOJ) until the Biden administration made the controversial decision to file a motion to dismiss the lawsuit on November 6, 2024.
In a letter addressed to Attorney General Pam Bondi, Republican Representatives Lance Gooden of Texas and Carol Miller of West Virginia highlighted their alarm over the decision made by the previous administration. They emphasized that halting the potential recovery of taxpayer funds poses serious ethical questions.
The lawmakers stated, “Despite investing three and a half years in investigating this case, it is deeply troubling that the DOJ reversed its position shortly after the presidential election, claiming the dismissal was in public interest while citing undue burdens on federal agencies.” They further scrutinized the lack of reasoning behind this swift decision, noting that the government had nothing to lose by allowing CMB Export to continue its legal process.
The letter from the lawmakers demands an investigation into several critical aspects of the Biden administration’s dismissal. Specifically, they want to examine the rationale for the decision, potential conflicts of interest, the sequence of events leading to the dismissal, and accountability regarding the possible misuse of taxpayer dollars.
Miller stressed the sentiment of many voters when she remarked, “The American people soundly rejected the Biden administration’s radical Green New Deal agenda and fraudulent coverups when they voted for President Trump.” She referred to the Crescent Dunes project as an energy proposal that ultimately cost taxpayers hundreds of millions and produced significantly less energy than promised. Moreover, she raised safety concerns associated with the project.
In defense of the dismissal, Biden’s DOJ argued that the decision was “commensurate with the public interest.” They stated that continuing the litigation would impose an “undue burden” on the federal government. However, this rationale is now being critically examined as lawmakers seek clarity.
The letter queries whether the timing of the dismissal was politically motivated, especially given that it took place shortly after the election results were announced. Lawmakers are questioning how the DOJ’s choice to dismiss a case aimed at recovering taxpayer dollars aligns with its fundamental duty to maintain accountability in cases of alleged government fraud.
The Republican representatives described the allegations in this lawsuit as a significant breach of public trust, stating that the issues surrounding the Crescent Dunes project – like many other failed green energy initiatives – have already burdened taxpayers financially. Their letter expressed serious concerns about the previous administration’s dedication to safeguarding public funds and prosecuting fraud effectively.
As a resolution, the lawmakers have urged the DOJ to conduct an internal review of the dismissal and consider allowing CMB Export to pursue its claims against Tonopah Solar Energy, LLC.
