U.S. regulations explicitly define the criteria for visa eligibility. The State Department’s consular officers enforce these rules for millions of visa applicants worldwide each year. According to the Immigration and Nationality Act (INA), individuals who advocate or engage in terrorist activities, or assist organizations like Hamas, are ineligible for U.S. visas.
Furthermore, the INA equips us with significant authority to revoke visas. This power is crucial for maintaining national security and ensuring the safety of Americans and lawful visitors. The previous administration’s strong stance on security and immigration law enforcement has set a precedent that we aim to uphold. It is both expected and mandated by law that all visa holders demonstrate ongoing eligibility for the duration of their visa.
Visa holders must understand that the rigorous security checks extend beyond the initial granting of a visa. In collaboration with the Department of Homeland Security and various law enforcement agencies, we consistently monitor visa cases. As Secretary of State, I will employ my authority to uphold the President’s zero-tolerance policy toward foreign nationals who support terrorism or engage in actions that threaten national security. The Supreme Court has consistently ruled that visa holders cannot invoke the First Amendment to justify actions that support designated terrorist organizations, such as Hamas or Hizballah. They will face serious consequences, including the possibility of visa denial, revocation, or even deportation.
Our primary duty is to safeguard the American public. During my tenure, we will act swiftly and decisively, coordinating closely with our government partners when credible information indicates that a visa holder poses a threat to security, violates U.S. law, or justifies revocation.
