Texas Cities Embrace New Policies on Illegal Immigration Enforcement
As many major cities governed by Democratic leadership across the United States resist the federal government’s immigration enforcement efforts, law enforcement agencies in Texas’ largest cities are taking a different approach. They are now notifying Immigration and Customs Enforcement, commonly referred to as ICE, when they come across illegal immigrants.
This shift follows ICE’s recent move to file administrative warrants in the National Crime Information Center, targeting around 700,000 unauthorized immigrants for arrest and deportation.
According to reports from the Houston Chronicle, police officers in Houston, the largest city in Texas, have been instructed to inform federal authorities whenever they encounter an illegal immigrant with an active federal administrative warrant. This marks a significant policy change for a city that has historically upheld more lenient immigration stances.
Implementation of New Policies in Houston
In line with the updated directive, officers from the Houston Police Department must reach out to ICE as soon as they detect an illegal immigrant with an administrative warrant. Once notified, officers will explore options for transferring the individual to ICE custody, which might involve detaining them on the scene until ICE agents arrive.
The implementation of this policy has already begun. For instance, ICE recently arrested Jose Armando Lainez Argueta, a 40-year-old Salvadoran national, following a routine traffic stop in Houston. His name appeared in the ICE system, leading to his subsequent detention.
San Antonio Follows Suit
San Antonio, Texas’ second-largest city and the seventh largest in the nation, is also adopting a similar policy. Local media outlet News 4 San Antonio reported that the San Antonio Police Department will now alert ICE when illegal immigrants are encountered, specifically those listed in the National Crime Information Center as having federal administrative warrants.
An email distributed to police officers outlined the new protocol, instructing them to contact the ICE Law Enforcement Service Center immediately and request that an ICE officer responds to the scene for the arrest of the individual.
The directives specified that those who might show up in the system could be previously deported felons, individuals who have been ordered deported or removed, or those with civil immigration detainer orders.
Collaboration with ICE in Bexar County
While the San Antonio Police Department did not respond to requests for comment, its coordinating agency, the Bexar County Sheriff’s Office, provided insight into its practices concerning illegal immigrant encounters. Although the sheriff’s office does not directly notify ICE about such encounters, it maintains a policy of collaboration. ICE officials frequently visit county jails to conduct interviews, often arriving as often as every three hours.
Bexar Deputy Sheriff Johnny Garcia commented on the agency’s approach, stating that ICE officials perform their visitation duties like any other law enforcement officer with the authority to enter the facility. He noted that they ensure there is no obfuscation in their procedures, allowing ICE interactions with newly arrested individuals as deemed appropriate.
Furthermore, sheriff’s office practices include notifying ICE Enforcement and Removal Operations officials 48 hours in advance of an illegal immigrant’s scheduled release from jail. This strategy aids ICE in planning their apprehension efforts effectively.
