Recent data reveals that nationwide injunctions against the Trump administration account for over half of all such injunctions issued against the federal government since 1963. This significant statistic highlights a growing trend in judicial intervention in executive policies.
Nationwide injunctions serve as sweeping court orders that prevent the federal government from enforcing specific policies or laws. These injunctions have the potential to create widespread effects across the country, impacting not just the parties directly involved in the legal case.
During his first term, Donald Trump faced an unprecedented 64 nationwide injunctions out of a total of 127 that have been issued since 1963. In stark contrast, only 32 injunctions were levied against the combined administrations of George W. Bush, Barack Obama, and Joe Biden since 2001. Consequently, this indicates that the Trump administration encountered twice as many nationwide injunctions as his immediate predecessors and successors combined, according to findings published in the April 2024 edition of the Harvard Law Review.
The findings showcased that the Bush administration dealt with six injunctions, while the Obama administration had 12, and the Biden administration faced 14. This disparity serves to underline the increasingly contentious relationship between Trump’s policies and the judiciary.
Trump’s return to the White House in January has triggered a wave of legal challenges, amounting to more than 120 lawsuits. These actions come from activists, government employees, and others who are opposing his executive actions. Alarmingly, these legal battles have led to numerous nationwide injunctions, including an astonishing 15 issued within February alone, as reported by Trump’s acting solicitor general, Sarah Harris.
On Thursday, Trump filed an emergency appeal with the Supreme Court, seeking to modify three injunctions that currently prohibit his efforts to nullify birthright citizenship. This appeal aims to ensure that the injunctions apply solely to individuals directly affected by the associated court decisions.
In her emergency appeal, Harris contended that nationwide injunctions are reaching
