Former President Donald Trump has urged Attorney General Pam Bondi to spearhead an inquiry into the purported misuse of an autopen by aides of current President Joe Biden. This demand aligns with Trump’s allegations regarding Biden’s mental fitness to fulfill his presidential duties.
In a detailed memorandum released on Wednesday, Trump outlined his concerns about the power that accompanies a presidential signature. He emphasized that this signature not only translates words into law but also appoints key officials, shapes national policies, and even grants clemency.
“In recent months, it has become increasingly apparent that former President Biden’s aides abused the power of Presidential signatures through the use of an autopen to conceal Biden’s cognitive decline,” Trump expressed. He characterized this situation as one of the most alarming scandals in American history, asserting that the public was deliberately misled about who was wielding presidential authority while Biden’s signature was applied to thousands of official documents.
Trump maintained that Biden has been suffering from “serious cognitive decline” for several years. He cited a recent Department of Justice (DOJ) conclusion that deemed Biden unfit for trial despite what Trump calls conclusive evidence of legal violations linked to his mental state.
Trump claimed that Biden’s cognitive issues were even more pronounced in private, with aides allegedly working to shield the public from the truth. “To do so, Biden’s advisors restricted his media appearances and scripted his interactions with officials and donors,” Trump added. The former president suggested that this strategy aimed to mask Biden’s inability to perform his duties effectively.
Despite these assertions, Trump noted that during Biden’s term, the White House issued over 1,200 presidential documents, appointed 235 judges to the federal bench, and issued more pardons and commutations than any previous administration.
Trump highlighted Biden’s controversial decision just days before Christmas 2024 to commute the sentences of 37 individuals on federal death row, including some with grave crimes.
“Although the authority for these executive actions goes to the President, there are serious questions about Biden’s awareness and decision-making regarding these actions,” Trump stated. He pointed out that many of Biden’s executive decisions were signed using a mechanical pen, or autopen, particularly in the latter half of his presidency.
Trump cautioned that if Biden’s advisors concealed his cognitive difficulties while directing the use of the autopen for significant executive actions, this could represent an unconstitutional exercise of presidential power. Such circumstances would carry serious legal implications regarding the validity of numerous actions taken in Biden’s name.
Furthermore, Trump’s memorandum specifies the need for an investigation into whether unnamed individuals conspired to mislead the American public concerning Biden’s mental state. This inquiry will particularly focus on actions that might have obscured the truth about Biden’s health, agreements among aides to dismiss videos of Biden’s cognitive capabilities as falsified, and procedures requiring false public statements that exaggerated the President’s competencies.
The investigation aims to clarify which official documents were signed using the autopen, including executive orders, clemency grants, and presidential memoranda, as well as identifying those who authorized Biden’s signature on these documents.
Last week, Trump expressed doubts about Biden’s alignment with many policies established during his administration, particularly regarding border security. He suggested that Biden’s team may have exploited the former president’s declining faculties, utilizing the autopen to implement drastic border directives.
The inquiry by House Republicans, led by Oversight Committee Chairman James Comer, commenced last month. The aim is to determine Biden’s mental fitness during the closing months of his presidency, as he faced health issues. Comer has indicated a willingness to bring Biden before the House to clarify the situation if deemed necessary.
