The White House has criticized the judicial branch for what it describes as erroneous behavior following multiple judicial blockades of President Donald Trump’s executive orders. White House Press Secretary Karoline Leavitt made these assertions during a news briefing on Wednesday.
Leavitt stated, “I would like to point out that the judges in this country are acting erroneously. We have judges who are acting as partisan activists from the bench.” This remark highlights the growing tension between the executive branch and the judiciary regarding executive power and immigration policy.
One significant case arose when Judge James Boasberg of the United States District Court for the District of Columbia issued an order halting deportations of migrants purportedly associated with the Tren de Aragua gang. This decision came under the Alien Enemies Act of 1798, which allows for the deportation of nationals from enemy states without a customary hearing.
Despite the court’s order, deportation flights to El Salvador proceeded. Leavitt argued that the judicial ruling had “no lawful basis,” as it was issued after the flights had already departed U.S. airspace.
In a show of solidarity with the administration’s stance, President Trump called for the impeachment of Judge Boasberg in a post on social media Tuesday. His remarks prompted a rare statement from Chief Justice John Roberts, who condemned the call for impeachment. Roberts asserted that for over two centuries, it has been understood that “impeachment is not an appropriate response to disagreement concerning a judicial decision.” This conflict illustrates a deeper struggle regarding the limits of judicial authority and the separation of powers.
In an effort to push back against judges perceived as partisan, the White House has suggested that the Supreme Court intervene. Leavitt stated, “The Supreme Court needs to reign in judges who are behaving as partisan activists and undermining the judicial branch.” She also affirmed that President Trump maintains respect for Chief Justice Roberts.
Congress has also seen attempts aimed at holding Judge Boasberg accountable. Representative Brandon Gill, a Republican from Texas, introduced an impeachment resolution against Boasberg, claiming that the judge was “guilty of high crimes” in his handling of the case.
Leavitt expressed concerns over what she characterized as a coordinated effort by the far-left to select judges who act as partisan activists. According to her, such actions aim to derail the Trump administration’s agenda. She declared, “It’s incredibly apparent that there is a concerted effort to judge shop, to pick judges who are clearly acting as partisan activists from the bench in an attempt to derail this president’s agenda. We will not allow that to happen.” This statement poses questions about the integrity and independence of the judiciary in political matters.
Despite the legal battles, the Trump administration remains committed to its mass deportation strategy. Leavitt indicated that while no immediate flights were scheduled to deport illegal immigrants to El Salvador, the campaign would persist. “We don’t have any flights planned specifically, but we will continue with the mass deportations,” she stated. She emphasized that Judge Boasberg’s ruling wrongly suggested that the President lacks the executive authority to deport foreign terrorists, describing it as “an egregious abuse of the bench.”
